Terms of service
The owner of the online store (hereinafter the Online store) is FORANS SIA, reg.No.: 40003395114, address: "Piepilsetas", Krustkalni, Kekavas novads, LV-2111, Latvia. The Online store provides information about Goods available on the website in accordance with the Terms of Use set forth below.
1. General terms
If the Purchaser purchases Goods through the Online store, then such mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia governing the Distance contract, including, but not limited to, the Law of the Republic of Latvia Regulations of the Cabinet of Ministers of the Republic “Regulations on Distance Contracts” etc.
The conditions of sale apply to purchases of Goods from the online store. The prices of the Goods sold in the online store are indicated next to the Goods. Shipping charges are added to the price. The shipping cost depends on the location of the Purchaser and the shipping method. The shipping cost is displayed when the Purchaser places the order. All prices are in Euros (€). Goods/services information is provided directly next to the goods/services in the Online store.
2. Placing an order
The prices and specifications of the Goods sold in the Online store are indicated next to the Goods. Add the desired Goods to your shopping cart to order them. Please fill in all required fields and select the most appropriate shipping method to complete your order. The total cost is then displayed on the screen. The main currency for payment on the website is Euro (EURO).
The purchase can be paid securely by choosing the following payment methods
• provided by the Maksekeskus AS payment platform:
1. Bank card — Visa or MasterCard (online payment).
2. Mobile payments — Google Pay and Apple Pay.
3. Internet banking — you can pay via internet banking with the following providers: Swedbank, SEB, Citadele, Luminor, Revolut, N26, WISE.
NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button. The personal data necessary for the execution of payments is transferred to authorized processor Maksekeskus AS.
• PAY PAL
The contract enters into force when the amount payable is transferred to the bank account of the Online store. If for any reason it is impossible to complete the order, the Purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded, no later than within 14 days of receiving the notification.
3. Shipment
Delivery of Goods in Latvia.The following delivery options are available: parcel lockers of our partners and courier service.
Delivery costs are covered by the Buyer; the corresponding price is displayed next to each delivery method.
Courier Delivery — choose this option if you prefer to have your order delivered directly to your home by a courier.
DPD Pickup / Omniva Parcel Lockers — when placing an order on evolu.lv, select the parcel locker that is most convenient for you.
You will receive an SMS notification once the order has been delivered to your selected location, along with instructions on how to collect it.
Please collect your parcel within 3 working days after receiving the SMS.
In exceptional cases, the online store reserves the right to deliver the order within up to 10 calendar days.
The online store is not responsible for delays in delivery if the order is not delivered on time or not delivered at all due to third-party actions beyond the Seller’s control or due to reasons related to the Buyer.

4. Right of withdrawal
According to the laws of the Republic of Latvia, customers have the right to withdraw from a distance purchase within 14 days of receiving the goods.To exercise the right of withdrawal, the following conditions must be met:
• the product has not been used;
• the product is in its original, undamaged packaging;
• the product is complete with all accessories;
• a proof of purchase is provided (receipt, invoice, etc.).
Products that cannot be returned:
According to Cabinet Regulation No. 255, the following products are non-returnable:
• Medical devices, if the packaging has been opened (e.g., inhalers, thermometers, blood pressure monitors, etc.);
• Hygiene products that have been opened or used;
• Products that are damaged due to use or improper storage.
In order to exercise the right of withdrawal, the Buyer must submit a withdrawal form by sending it to the e-mail address: info@evolu.lv and send the Product and the withdrawal form to the Online Store within 14 days of receiving the Goods.
If the Goods have been used for any purpose other than is necessary to ensure the nature, characteristics, and functioning of the Goods, or if there are any signs of use or wear and tear, the Online store has the right to lower the amount returned in accordance with the decrease in the value of the Goods.
The Purchaser shall bear the cost of returning the Goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective Goods).
The Purchaser must return the Goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the Goods to the carrier within the aforementioned period.
Upon receiving the returned Goods, the Online store shall return to the Purchaser, no later than after 14 days, all of the payments received from the Purchaser based on the contract.
The Online store has the right to refuse to make a refund until the Goods being returned are received or until the Purchaser has provided proof of returning the Goods, whichever occurs first.
If the Purchaser has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the Online store, the store is not required to compensate the cost exceeding the usual shipping cost.
The Online store has the right to withdraw from the sale and demand that the Goods be returned by the purchaser if the marked price of the Goods in the Online store is significantly lower than the market price of the Goods due to an error.
5. Defective goods
Maintenance of all Goods offered in the Online Store is provided in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (PTAL). The Buyer has the right to file a claim regarding the Goods that do not meet the requirements within 24 months from the date of receipt of the Goods. The warranty period, in connection with the use of a product for commercial purposes, for legal entities is 12 months.
Before using the purchased product, read the instructions carefully and use the product only in accordance with the manufacturer's instructions, in accordance with the characteristics of the product and the intended use.
If the non-compliance of the goods with the terms of the contract is insignificant and cannot significantly affect the Buyer's ability to use the goods, the Buyer is not entitled to demand termination of the contract and a refund.
To receive services, the Buyer must keep and present a document confirming the purchase (receipt, waybill), as well as transfer the goods to the Seller in full. Transport costs are borne by the Buyer.
For electronic goods, during maintenance, please keep the packaging and, in case of claims, present the goods in the original packaging of the manufacturer in order to avoid mechanical damage to the goods, as a result of which the functionality of the goods may be lost.
Service for accessories, batteries, connecting cords and other components that wear out during operation is not available or limited.
The Online store is not liable for any defects arising after delivering the Goods to the Purchaser.
If the purchased Goods have defects for which the Online store is responsible, the Purchaser has the right to request the elimination of defects in the Goods or the exchange for new goods free of charge.

If the Goods cannot be repaired or replaced, the Online store will return all payments provided for in the Distance Agreement to the Purchaser . The Online store shall provide a written response to the consumer's complaint within 15 days.
Service is not valid if the Product:
1. there is mechanical damage caused by the customer's fault;
2. it is established that the warranty seal, serial number of the manufacturer of the Product is damaged, the product has not been entered in accordance with the instructions and / or the Buyer has tried to repair the damage himself;
3. there is damage caused by natural disasters, lightning, fire, flood, etc. as a result;
4. there is damage caused by the ingress of foreign objects, liquids, insects, etc .;
5. there is damage caused by exposure to chemicals;
6. there is damage caused by fluctuations or damage to electrical voltage, inadequate communication and cable parameters, as well as in the case of other household factors (soot, smoke, dust, humidity, etc.);
7. the damage has occurred due to the fact that the Product was not used in accordance with its instructions for use, that the conditions for storage and transportation of the Product were not observed, as well as in cases when the product was not installed in accordance with the instructions;
8. the damage is due to the fact that it is not used for its intended purpose;
9. use of non-standard power supplies, accessories and spare parts that have not been certified by the manufacturer for use with the specified Product and if this has caused damage to this Product;
6. Direct marketing and processing of personal data
The Online store only uses the personal data entered by the purchaser for processing the order and sending Goods to the Purchaser. The Online store forwards personal data to the transport service provider in order to deliver the Goods.
The Online store sends newsletters and offers to the Purchaser’s e-mail address only if the Purchaser has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.
The Purchaser may opt out of offers and information booklets at any time by notifying the Online store of this by e-mail or by following the instructions in the e-mail containing the offer.
7. Settlement of disputes
Service for all Goods offered in the Online Store is provided in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (PTAL). The Purchaser has the right to file a claim for non-compliant Product within 24 months from the receipt of the Product. For legal entities, the warranty period in connection with the use of the product for commercial purposes is 12 months.
All disputes that will arise between the Purchaser and the Online store, or that will arise in connection with the purchase of Goods in the Online store, the parties will try to resolve through mutual negotiations or correspondence, with the aim of reaching a mutually beneficial and acceptable solution.
The Purchaser may submit claims and / or complaints regarding the Goods and / or services purchased in the Online Store to the Consumer Rights Protection Center, address: Brīvības iela 55, Rīga, LV-1010, by calling: +371 65452554, or by writing to the e-mail address: ptac@ptac.gov.lv, or on the website of the Consumer Rights Protection Center: www.ptac.gov.lv.
Information on Online Dispute Resolution (ODR): The European Commission offers an online dispute resolution platform. This platform is intended to facilitate the out-of-court settlement of contractual disputes over online sales and service contracts. The platform is available at https://ec.europa.eu/consumers/odr/.
If the dispute is not resolved in the form of negotiations or correspondence, the Parties shall resolve the dispute in the court of the Republic of Latvia, in compliance with the laws and regulations of the Republic of Latvia. Disputes between the Purchaser (consumer) and the Online store may be referred to the Consumer Rights Protection Center or a court of the Republic of Latvia.
